iTrack4Tax Terms of Service
These Terms of Service ("Terms") are an agreement between you and Bufo Labs LLC ("we," "us," "our") for your use of the iTrack4Tax app and related services (the "App"). By creating an account or using the App, you agree to these Terms. If you use the App on behalf of a business, you agree to these Terms on its behalf.
1. What the App does, and doesn't do
iTrack4Tax is a record-keeping tool that helps you organize mileage, expenses, reimbursements, and distributions. Bufo Labs LLC does not provide tax, legal, accounting, or financial advice, and the App doesn't prepare or file tax returns. Reports, IRS form-line groupings, mileage rates, and categorizations are provided for your convenience and may not fit your situation. You're responsible for your tax filings and should consult a qualified professional.
2. Your account
You must be at least 18 years old and able to form a binding contract. Keep your sign-in credentials secure, and tell us promptly about any unauthorized use. Your account can be active on one device at a time. You're responsible for activity in your account.
3. Your data
You own the records, receipts, and other content you put in the App ("Your Data"). You give us permission to host, store, process, and display Your Data only as needed to run the App for you and the people you share it with. Our Privacy Policy explains how we handle it. You're responsible for the accuracy of Your Data and for having the right to add information about other people, such as LLC members.
Keep your own copies of important tax records. Use the App's export features regularly.
4. Shared access
When you invite others to an entity or workspace, they can view and change Your Data according to the role you give them. You're responsible for who you invite and the roles you assign. You can change or remove access at any time.
5. Acceptable use
Don't use the App to break the law, to commit fraud (including tax fraud), to access other users' data, to interfere with or reverse-engineer the service except where the law allows, or to upload malicious code.
6. Fees
If we offer paid features, the price and terms will be shown before you buy. Purchases made through the App Store are processed by Apple under its terms.
7. Changes and availability
We may update, change, or discontinue features. We'll try to give reasonable notice of significant changes, and of any shutdown of the App so you can export Your Data. We don't guarantee the App will be uninterrupted or error-free.
8. Ending your use
You can stop using the App and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these Terms. Sections 1, 3, 9, 10, and 11 continue to apply after your access ends.
9. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE EXTENT THE LAW ALLOWS, Bufo Labs LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, TAX PENALTIES, OR INTEREST, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM OR US$50.
11. Governing law
These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Alabama, unless the law where you live requires otherwise.
12. Apple
If you got the App from the Apple App Store, you acknowledge that these Terms are between you and Bufo Labs LLC, not Apple. Apple isn't responsible for the App or its content, has no obligation to provide support or maintenance, and isn't responsible for any claims about the App. To the extent allowed by law, Apple has no other warranty obligation for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must follow any applicable third-party terms, such as your wireless carrier's.
13. Changes to these Terms
We may update these Terms. We'll post the new version here and update the effective date. If the changes are significant, we'll tell you in the App. If you keep using the App after changes take effect, you accept the new Terms.
